Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and the individual developer of WholeBean ("WholeBean," "we," "us," or "our") governing your use of the WholeBean iOS application and related services (the "App"). Please read them carefully. By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
These Terms incorporate, and are in addition to, Apple's Licensed Application End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple EULA conflict, the provision more protective of your rights as a user controls for the subject it addresses.
Our Privacy Policy explains how we handle your information and is part of these Terms by reference.
1Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) and able to form a binding contract to use the App. The App is intended for adults interested in coffee and is not directed to children. If you are using the App on behalf of someone else, you represent that you are authorized to accept these Terms for them.
2Your account
The App requires you to sign in before use. You may sign in with Sign in with Apple, Google, or an email address and password. You are responsible for:
- providing accurate information and keeping it current;
- maintaining the security of your credentials and device; and
- all activity that occurs under your account.
Notify us promptly at the contact address below if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms or that we reasonably believe create risk or legal exposure for us or other users.
3The service
WholeBean lets you photograph coffee bags and labels, identify the beans, save them to a personal collection, record how you enjoyed them, optionally tag the café where you had them, and view a taste profile derived from your collection. When you are signed in, your collection is synced to private, account-scoped cloud storage so it follows you across devices and reinstalls.
We may add, change, or remove features, and we may set or change limits on the service, at any time. We may also discontinue the App, in whole or in part, with reasonable notice where practicable.
4AI-generated content — important disclaimer
WholeBean uses third-party artificial-intelligence services (including Google's Gemini) with web-search grounding to identify coffees and to generate summaries, flavor analyses, and brewing recommendations.
This AI-generated content is provided for informational and entertainment purposes only. It may be inaccurate, incomplete, or out of date. Bean identifications, origins, processing details, roast levels, tasting notes, and brew suggestions are best-effort estimates, not statements of fact, and should not be relied upon as authoritative.
Do not rely on the App for health, allergen, dietary, medical, or safety decisions. If you have a food allergy or sensitivity, or any health concern, rely on the product's own packaging and the manufacturer or your healthcare provider — not on the App. You are solely responsible for how you use any information the App provides.
5Your content
"Your Content" means the photos, tasting notes, experiences, venue selections, and other material you create or upload in the App.
- You own Your Content. These Terms do not transfer ownership to us.
- You grant us a limited, non-exclusive, worldwide license to host, store, process, transmit, and display Your Content solely to operate the App for you — for example, to recognize text from your label photos, sync your collection to your account, and display it back to you. We do not use Your Content to train our own AI models, and we do not sell it.
- You represent that you have the rights to the content you upload and that it does not infringe anyone's rights or violate any law.
To enable bean identification and insights, the App sends the text recognized from your label photos and a bean's identifying details to our AI provider as described in the Privacy Policy.
6Acceptable use
You agree not to:
- use the App for any unlawful purpose or in violation of these Terms;
- upload content that is infringing, unlawful, or that you have no right to share;
- attempt to access another user's account or data;
- reverse-engineer, decompile, extract, or attempt to obtain source code or data except as permitted by law;
- interfere with, overload, or disrupt the App or its providers; or
- misuse the AI features to generate unlawful or abusive content.
7WholeBean Pro subscription
WholeBean is free to download and use with certain limits. WholeBean Pro is an optional auto-renewable subscription that unlocks additional features (such as an unlimited bean collection and the full taste profile).
- Plans and pricing. WholeBean Pro is offered on a monthly and an annual plan. The current price, billing period, and free-trial or introductory terms (if any) are shown in the App and on the App Store at the time of purchase.
- Billing through Apple. All purchases are processed by Apple through your App Store account. We do not receive or store your payment details.
- Auto-renewal. Subscriptions automatically renew at the then-current price unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Managing and cancelling. You can manage or cancel your subscription, and turn off auto-renewal, in Settings → your Apple ID → Subscriptions on your device. Cancelling stops future renewals; you keep Pro access through the end of the paid period.
- Refunds. Purchases are handled by Apple and are subject to Apple's refund policies. We generally cannot issue refunds directly.
Cancelling a subscription does not delete your account or collection; see the Privacy Policy for data deletion.
8Third-party services
The App relies on third-party services — including Apple (sign-in, maps, payments), Google (sign-in and the Gemini AI service), and Supabase (authentication, database, and storage). Your use of those services through the App is also subject to their respective terms and privacy policies. We are not responsible for third-party services, and their availability is not guaranteed.
9Intellectual property
The App, including its software, design, branding, and content we provide (excluding Your Content and third-party content), is owned by us or our licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use. All rights not expressly granted are reserved.
10Disclaimers
The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, secure, error-free, or that any information it provides — including AI-generated identifications and recommendations — will be accurate or reliable. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
11Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App. Our total liability for any claim relating to the App will not exceed the greater of (a) the amount you paid us for the App in the twelve months before the claim, or (b) US $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the App, your violation of these Terms, or your violation of any law or third-party right.
13Termination
You may stop using the App and delete your account at any time (see the Privacy Policy for deletion). We may suspend or terminate your access if you violate these Terms or as needed to comply with law or protect the service. Sections that by their nature should survive termination — including content ownership, disclaimers, limitation of liability, and indemnification — will survive.
14Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Florida will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the App, and you consent to personal jurisdiction and venue there, except where applicable law gives you the right to bring a claim in your local courts. Apple is not a party to these Terms and is not responsible for the App.
15Apple-required terms
You and we acknowledge that these Terms are between you and us only, not with Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will, where applicable, refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
16Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide notice within the App. Changes take effect when posted. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
